Art. 1: General Provisions
The e-commerce website of AQUALEX nv, a company with registered office at Nijverheidslaan 60A, 8540 Deerlijk BE0822.110.137, offers its customers the possibility to purchase the products from the webshop online.
These General Terms and Conditions (“Terms”) apply to every order placed by a visitor of this e-commerce website (“Customer”). By placing an order through the webshop, the Customer explicitly accepts these Terms, thereby agreeing to the applicability of these Terms, to the exclusion of all other terms. Additional terms of the Customer are excluded, unless they have been expressly accepted in writing by AQUALEX in advance.
Art. 2: Price
All listed prices are expressed in EURO, always including VAT and all other taxes or charges payable by the Customer.
If delivery, reservation, or administrative costs are charged, these will be stated separately.
The stated price applies solely to the items as described in words. Accompanying photos are intended for decorative purposes and may contain elements not included in the price.
Art. 3: Offer
Although the online catalog and e-commerce website are compiled with the utmost care, it is possible that the provided information is incomplete, contains material errors, or is not up-to-date. Apparent mistakes or errors in the offer do not bind AQUALEX. AQUALEX is only obliged to make reasonable efforts regarding the accuracy and completeness of the provided information. AQUALEX is in no case liable for manifest material errors, typesetting, or printing errors.
We do our best to represent the colors of the items as accurately as possible. However, it is possible that the colors in the photos differ slightly from the real colors. This may, for example, depend on your computer screen.
If the Customer has specific questions about e.g., sizes, color, availability, delivery time, or delivery method, we request that the Customer contact us in advance via info@aqualex.eu.
The offer is valid while supplies last and may be adjusted or withdrawn by AQUALEX at any time. AQUALEX cannot be held liable for a product being unavailable. If an offer has a limited validity period or is made under conditions, this will be explicitly stated in the offer.
Art. 4: Online Purchases
The Customer can pay via bank transfer to a BE account, via credit card (Visa or Mastercard), via Bancontact, via iDEAL, or via PayPal.
AQUALEX is entitled to refuse an order in case of a serious breach by the Customer concerning orders in which the Customer is involved.
Art. 5: Retention of Title
The delivered items remain the exclusive property of AQUALEX until full payment by the Customer.
The Customer undertakes, if necessary, to inform third parties of AQUALEX’s retention of title, e.g., to anyone who may attach the items not fully paid for.
Art. 6: Withdrawal Period and Return Conditions
Within the framework of distance selling to consumers falling under the scope of the Law of 6 April 2010, the Customer has the right to inform the seller that he or she withdraws from the purchase, without payment of a penalty and without giving any reason, within 14 (fourteen) days from the day following delivery.
If the consumer exercises this right, they must return the goods in their original condition, with the original labels, unused, and in the original packaging, at their own risk and expense, to AQUALEX, Nijverheidslaan 60A, 8540 Deerlijk, Belgium.
Unpaid return shipments will not be accepted.
The return shipment will be inspected by AQUALEX. After a successful inspection, the item will be reimbursed to you. You can expect a refund to your account within 2 (two) weeks or choose to receive store credit. Items returned after 14 days are not eligible for a refund or store credit.
Orders paid with a gift card will never be refunded in cash in the event of a return. A new gift card will be issued. The provisions of this article apply only to Customers who purchase items online from AQUALEX as consumers.
If the returned product has decreased in value in any way, AQUALEX reserves the right to hold the Customer liable and claim compensation for any reduction in value of the goods resulting from the Customer’s use of the goods beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

Art. 7: Sanctions for Non-Payment
Without prejudice to the exercise of other rights available to AQUALEX, in case of non-payment or late payment, the Customer owes by operation of law and without notice of default an interest of 10% per year on the unpaid amount from the date of default. In addition, the Customer owes by operation of law and without notice of default a fixed compensation of 10% on the amount concerned, with a minimum of 25 euros per invoice.
Without prejudice to the above, AQUALEX reserves the right to take back items that are not (fully) paid.
Art. 8: Applicable Law
Belgian law applies to these Terms of Sale. The Court of Kortrijk has exclusive jurisdiction.
